Park, including their officers, directors, affiliate, agents, employees, guests and Partnering Corporations, shall release, indemnify and hold each other harmless from any damages, loss or liability, (including reasonable attorneys fees, if any) for property damage or personal injury arising out of the event, except to the extent such loss or damage is a result of the negligence or willful misconduct of the other party, its agents, employees, contractors or guests. In furtherance of the foregoing indemnity, each party hereby expressly waives any and all statutory and/or constitutional immunity to which, but for this waiver, such party might be entitled (i) not presently contemplated by the terms of this agreement, (ii) incurred either pursuant to Corporate Partner's explicit instructions or pursuant to Corporate Partner's approval after consultation and (iii) incurred otherwise than through the negligence of fault of park".
